We're looking for a Litigation Attorney, Personal Injury Litigation and Subpoena Response at an exciting time. We've successfully launched multiple platforms and products, raised over $100m in VC funding, reached profitability, and have a growth trajectory of over 100% YoY.
WHAT YOU WILL BE GETTING INVOLVED IN:
You will join Scan.com's in-house legal team in Atlanta in a high-volume, litigation-focused role centred on managing third-party subpoenas received from personal injury plaintiffs and defendants seeking access to patient diagnostic imaging records. Reporting to the General Counsel, you will work hand-in-hand with a dedicated paralegal, the medical records team, and outside counsel to protect patient privacy, preserve Scan.com's legal interests, and ensure compliance with applicable state and federal law. This is an opportunity to shape and build Scan.com's subpoena response function as the company scales nationally.
As a scale-up business, you can expect your role to develop over time. Here are some of the types of things you could be getting involved in:
Review and evaluate high-volume third-party subpoenas seeking patient diagnostic imaging records in personal injury matters.
Draft and file timely objections to subpoenas that are legally defective, procedurally improper, or otherwise invalid, including overbroad or disproportionate discovery requests.
Ensure subpoena responses comply with applicable state and federal laws, including HIPAA, state privacy statutes, and civil procedure rules.
Develop and maintain standardised objection templates and response protocols to support consistent, efficient handling across a high-volume docket.
Manage requests for depositions of Scan.com personnel, including corporate representative depositions, and prepare and coach deponents on topics, anticipated questions, and company policies.
Partner closely with the medical records team to understand record-keeping systems, locate responsive documents, and ensure accurate, timely production where required.
Correspond directly with plaintiff and defence attorneys to negotiate subpoena scope, resolve disputes, and manage deadlines.
Supervise and delegate work to a dedicated paralegal, providing direction and oversight on day-to-day subpoena workflow management.
Advise internal teams on the legal implications of subpoena requests and contribute to refining internal legal policies and procedures related to records requests and subpoena management.

Stay current on developments in personal injury litigation, discovery law, and health records privacy regulations in relevant jurisdictions.

Establish a standardised, scalable subpoena response function with objection templates, response protocols, and matter tracking that hold up across a high-volume docket.
Measurably reduce risk and improve response speed across Scan.com's subpoena workflow, tracked against clear KPIs agreed with the General Counsel.
Become the trusted point of contact for opposing counsel on subpoena matters, consistently protecting patient privacy and Scan.com's legal interests.
Build strong working relationships with the medical records team, operations, and outside counsel to enable smooth, accurate production where required.

Develop and mentor the paralegal function alongside the General Counsel, creating the foundation for the legal team to scale with the business.
WHAT YOU MIGHT BRING TO THE TABLE:

Juris Doctor (J.D.) from an ABA-accredited law school.
Active bar licence in Georgia (or eligible for admission on motion); admission in additional states is a plus.
Substantial litigation experience with a meaningful focus on personal injury matters.
Demonstrated experience handling third-party subpoenas, including drafting objections and managing subpoena response workflows.
Strong knowledge of Georgia civil procedure rules and the federal rules governing third-party discovery.
Thorough understanding of Georgia tort reform and its implications for personal injury litigation, including damages caps, apportionment of fault, and evidentiary standards.
Proven ability to manage a high-volume docket while maintaining attention to detail and meeting strict deadlines.
Excellent written and oral communication skills, including direct experience corresponding with opposing counsel.
Experience preparing and defending witnesses for depositions.
Prior in-house legal experience in a healthcare, health-tech, or medical records environment is a plus.
Familiarity with HIPAA and other health information privacy regulations as applied to litigation and subpoena response.
Prior experience supervising or mentoring paralegals or junior legal staff.

HOW WE WILL INTERVIEW YOU:
We keep our interview process short and sweet, and we're a nimble team that can progress at pace. Here are the stages you can expect, but we might switch up the order of each step depending on team availability:
Introductory call/interview with Devin, our Senior Talent Partner. The call is via telephone and will last around 30 minutes.
Should it feel like there is an initial fit for all, we will invite you to a video call with the hiring manager for around 45 minutes. This is a more structured interview that will deep-dive into the role and technical needs.
All of our roles will have a small assessment stage. This might be in person, a take-home assessment, or further video calls. Length varies, but we're mindful of your time and try to keep it as simple as possible.
